Wrongful Death occurs when one person is killed as the result of irresponsible or negligent behavior of another individual, employer, company, or entity. It is an unintentional death that could have been avoided if the proper attention had been paid. Wrongful Death may be the result of medical malpractice, a car or airplane accident, exposure to hazardous substances or conditions, or if a person is killed during an activity that was supervised. The circumstances needed to claim Wrongful Death require proof that the death of a human being was the direct cause of someone's negligence or strict liability. In addition, the surviving family members suffering monetary injury from the death of the deceased must be present, as well as a personal representative for the deceased.
