The Federal Employers’ Liability Act (FELA) requires railroad companies to maintain a reasonably safe workplace. The railroad company must ensure the workplace is reasonably free from safety hazards and unsafe conditions. This extends to the maintenance of equipment and tools. The employer must warn employees of any unsafe conditions or hazards, even if the employee should be aware of that danger. The railroad company also must inspect the workplace to ensure it is free of hazards. If an employee is injured by a condition that could have be discovered during a reasonable inspection, the employer can be liable under FELA.
