Workers’ Compensation is a system of benefits designed to aid employees who are disabled or injured on the job. Because it provides fixed financial awards and medical care, Workers’ Compensation eliminates the right of employees to sue their employers for work related injuries. Workers’ Compensation is a “no fault” system; it protects both employees and employer. That is, the negligence of workers, co-workers, or employers is not an issue in a Workers’ Compensation claim; injuries are covered regardless of fault. Benefits are determined by the department of labor in each state, and the specifics vary by jurisdiction. It should be noted that a Workers’ Compensation claim is a request for benefits; it is not a lawsuit.
