Strict Liability


Strict liability, sometimes called “absolute liability”, means that the defendant is held responsible for injuring another person regardless of negligence or intent.  If the accident was the result of a defective product, the manufacturer of that product is liable without question if the plaintiff can prove their injuries were caused by the defective product, and that the product was allowed to be sold. If it is determined that the product in question was responsible for the damage inflicted on the injured party, it is deemed “unreasonably dangerous” and the manufacturer is held responsible.  Faulty brake liners or abused and under-inflated tires are both example of a defective product that might involve strict liability for the manufacturer.
