Medical Payments, PIP and No-Fault Coverage

Medical Payments, PIP and No-Fault Coverage

Medical payments (MedPay) coverage pays for the medical expenses resulting from injuries sustained by you and your passengers in an auto accident. You are also covered if you're driving someone else's car with their permission. In addition, you and your family members are covered if you are injured as pedestrians. MedPay will pay regardless of who was at fault for the accident. However, if someone else was at fault for your accident, your insurance company may subrogate against them. This means it will seek damages from the at-fault party.

Personal Injury Protection (PIP) coverage is an expanded form of medical payment protection that is required in sixteen states. Also known as no-fault auto insurance, it covers medical expenses and lost wages for you and your passengers who are injured in a car accident regardless of who caused the accident. It also covers funeral costs in the event of an auto accident fatality. Pain and suffering, vehicle damage, and any other expenses over the policy limits generally aren't covered. The laws about the circumstances under which you can sue the at-fault driver for damages not covered by your no-fault insurance vary by state.

The following states require PIP coverage:

  • Arkansas
  • Delaware
  • Florida
  • Hawaii
  • Kansas
  • Kentucky
  • Maryland
  • Massachusetts
  • Michigan
  • Minnesota
  • New Jersey
  • New York
  • North Dakota
  • Oregon
  • Pennsylvania
  • Utah
