What is a Duty to Defend?

 

The “duty to defend” comes from the obligations in the insurance policy. For instance, if you are a landlord and someone falls in front of your apartment building and claims to have been injured, your insurance company would have an obligation to honor that claim and provide defense counsel to you. Our firm handles those claims where we provide defense to that landlord, who has been sued by the passerby who claims of being injured on the side walk.
