Statute of Limitations: 2 years from the time of injury. In the case of foreign objects, the statute of limitations is one year from the time the object was or should have been discovered or two years from the time of the injury, whichever is later. (§5.219)

Minimum Qualifications of Expert Witnesses: Must have both professional expertise and practical knowledge and understanding of the standard of care in the area. (§6.1013)

Limitations on Monetary Damages: Non-economic damages are limited to $250,000 and are adjusted each year in accordance with the state’s adjustment of the average annual wage. Punitive damages are limited to 3 times the compensatory damages or $250,000.(§6.1603-4)

Limitations on Attorney Fees: There are no limits on attorney fees.
