Death on the High Seas Act (DOSHA) covers deaths occurring more than three nautical miles from the shore of any state. A personal representative can bring a DOSHA action on behalf of the decedent’s children, spouse, parent or financially dependent relative. Monetary damages under DOSHA are based on the projected or actual value of financial benefit that would have been received from the deceased seaman. This allows dependent children to recover for the value of care and guidance they would have been given from the deceased parent. A husband or wife can recover for the actual value of financial assistance the deceased seaman would have made to the family had he not passed away. DOSHA does not allow for a loss of consortium or society claim, but a husband or wife can recover for the monetary amount of any household services the deceased would have provided.Death on the High Seas Act
