The responsibility of construction site owner depends on the amount of control he or she gives to an independent contractor. The landowners may not be considered the legal possessor of the land for the duration of the project. The person with legal control of the construction site, not necessarily the landowner, assumes the liability for the site. Whoever owns or possesses the land at the time of construction is liable for any injuries that occur to anyone involved in the project that are caused by potentially harmful conditions on the land that the possessor knew or should have known of. This duty does not extend, however, to dangerous conditions that should be obvious to those involved, and the duty can be eliminated (or lessened) depending on the independent contractor’s knowledge and corresponding duties.Construction Site Owner
