Auto Accident: Two Types of Pedestrian Cases


Pedestrian cases really involve two classes of people. The first is your traditional pedestrian, the person walking down the street or typically crossing the street when they’re involved in the accident. The second biggest class of pedestrians are people on their bicycles.

Thanks to a Supreme Court ruling last year, pedestrian cases have become a lot easier to handle in Pennsylvania. That is because all pedestrians are now considered to be covered by the full tort option.

We have two tort options in Pennsylvania. Full tort which allows you to always bring your claim, and limited tort which puts certain limits on your claim. It used to be when you were a pedestrian you were still stuck with whatever tort option went with the car you owned. Now, however, thanks to a Supreme Court ruling in 2006 every pedestrian is given the benefit of the full tort option, thus making pedestrian cases among the simplest and straight forward to handle.
